How long is Form W-8BEN valid?

Under Treasury Regulation § 1.1441-1(e)(4)(ii), a Form W-8BEN remains valid starting on the date signed and running through the end of the third full calendar year (approximately 3 to 4 years), unless a change in circumstances makes any information invalid.

Do I have to file a US tax return (Form 1040-NR)?

If you performed 100% of your contractor services outside the US and had zero US withholding deducted, you do not need to file a US federal tax return with the IRS. You only report and pay taxes in your country of tax residence.

What happens if a US client erroneously withheld 30%?

If your client withheld 30% because you did not submit Form W-8BEN in time, they will issue you a Form 1042-S by March 15. You can file IRS Form 1040-NR to claim a full refund of the erroneously withheld tax citing IRC § 862(a)(3).

What if my country does not have a US tax treaty?

Even without a double taxation treaty (e.g. Nigeria, Brazil, Kenya), independent services performed 100% offshore are Foreign-Source Income under IRC § 862(a)(3) and are exempt from US withholding. Treaties are primarily needed for royalties and dividends.
